Terms of Service
These terms govern your use of Ethogram. They take effect on 9 October 2026. By creating an account or using the Service, you agree to them.
Who we are
These terms are an agreement between you and Ethogram, Portugal (“Ethogram”, “we”, “us”). Contact and legal notices: [email protected].
The Service
Ethogram provides agentic behavior analytics: it shows which AI agents visit your websites, what they do and where they get stuck. These terms cover our website, dashboard, script, integrations and related services (the “Service”). Our Privacy Policy explains how we handle personal data.
If you use the Service for an organisation, you confirm you can bind it to these terms, and “you” means that organisation. A signed order form with us takes precedence where it conflicts with these terms.
Early access and changes to the Service
Ethogram is in early access. We may modify, suspend or discontinue any part of the Service, or limit its use, at any time.
Eligibility and accounts
The Service is for businesses and professionals. You must be at least 16 and able to enter into a binding contract. Keep your account information accurate and your sign-in details secure; you are responsible for all activity under your account.
Installing Ethogram
You may install the Ethogram script or integrations only on websites you own or are authorised to manage. You are responsible for how you install and remove them. We may update the script at any time.
Your data
You own the data the Service collects from your websites and anything else you submit (“Customer Data”). You grant us a worldwide, non-exclusive, royalty-free licence to use, host, copy, process and display Customer Data to operate, provide, secure and improve the Service.
We may create aggregated and de-identified data from Customer Data and use of the Service. We own that data and may use it for any purpose, including research, benchmarks and publications, provided it does not identify you or any individual.
Where Customer Data includes personal data, we process it as your processor under our Data Processing Agreement, available on request at [email protected]. You are responsible for having a lawful basis to collect it and for giving any notices your visitors require.
Acceptable use
You agree not to:
- break the law or infringe anyone's rights, including through the data you send us;
- use the Service for unlawful tracking or profiling of individuals;
- access other customers' data, or probe or bypass our security;
- overload or disrupt the Service, or send artificial traffic;
- copy, decompile or reverse engineer the Service, except where the law allows it;
- resell the Service or use it to build a competing product.
Fees
The Service is free during early access. We may introduce paid plans; we will give you notice before charging you, and you will only be charged if you choose a paid plan.
Intellectual property and feedback
We own the Service and all rights in it. We give you a limited, non-exclusive, non-transferable right to use it while your account is open. If you send us feedback, we may use it freely without obligation to you.
Publicity
We may name you and show your logo as a customer of Ethogram in our marketing. To opt out, email [email protected].
Confidentiality
Each of us will protect the other's non-public information with reasonable care and use it only for the purposes of these terms, except where disclosure is required by law.
Suspension and termination
You can stop using the Service and delete your account at any time. We may suspend or terminate your access at our discretion if you breach these terms or your use creates risk for us, other users or third parties, and otherwise on notice. Provisions that by their nature should survive termination will survive.
No warranty
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy and uninterrupted availability, to the extent the law allows. Agent classifications may be wrong or incomplete, and you are responsible for decisions you make based on them.
Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential losses, or for loss of profits, revenue, goodwill or data, and our total liability is limited to the greater of the fees you paid us in the 12 months before the claim and €100. Nothing in these terms limits liability that cannot be limited under applicable law.
Indemnity
You will defend and indemnify Ethogram against third-party claims, and related losses and costs, arising from your Customer Data, your websites, or your breach of these terms or the law.
Changes to these terms
We may update these terms at any time. Changes take effect when posted here, and where reasonable we will notify you of material changes. Continuing to use the Service means you accept the updated terms.
Governing law
These terms are governed by the laws of Portugal, and the courts of Portugal have exclusive jurisdiction, without prejudice to any mandatory consumer protections that apply to you.
General
These terms, the Data Processing Agreement and any order form are the entire agreement between us. If any part is unenforceable, the rest remains in effect. You may not transfer these terms without our consent; we may transfer them to a successor.
